General Terms and Conditions of Collected Photo (Pohlmann & Völcker GbR)

§ 1 Scope and Definitions
(1) These Terms and Conditions apply to all contracts concluded between you as a customer and us, Pohlmann & Völcker GbR, Collected Photo, Heynstraße 15, 13187 Berlin, Germany, via our online shop https://collected.photo.
(2) "Consumer" means any natural person who enters into a legal transaction for purposes that predominantly are not related to their commercial or independent professional activity. "Entrepreneur" means any natural or legal person or a legal partnership who acts in the exercise of their trade, business or profession.

§ 2 Conclusion of Contract
(1) The product presentations in our online shop do not constitute legally binding offers but an invitation to place an order.
(2) By completing the ordering process, you submit a binding offer to purchase the selected products.
(3) The contract is concluded when we confirm your order by email within 3 business days.

§ 3 Prices and Payment
(1) All prices include the applicable statutory VAT and other price components.
(2) In addition to the stated product prices, shipping costs apply.
(3) We accept the following payment methods:

  • PayPal

  • Shopify Payments (incl. credit card, Apple Pay, Google Pay, etc.)
    (4) The purchase price is due upon conclusion of the contract.

§ 4 Shipping and Delivery
(1) Orders are shipped with DHL and Deutsche Post.
(2) We deliver to Germany, the EU, and worldwide.
(3) Shipping costs are calculated based on weight (and size, if applicable) and are shown at checkout.
(4) Estimated delivery times:

  • Germany: 2–4 business days

  • EU: 5–10 business days

  • International: 6–14 business days
    (5) Orders are dispatched within 1–2 business days (max. 3).
    (6) Tracking is provided.
    (7) We do not offer local pickup.
    (8) Delivery to DHL Packstations is supported.
    (9) We ship Monday to Friday. No shipping on weekends or during public holidays (e.g. Christmas, Easter, New Year). Delays may occur during these periods.

§ 5 Retention of Title
The goods remain our property until full payment is received.

§ 6 Right of Withdrawal
As a consumer, you have the right to withdraw from this contract. Details can be found in our [Revocation Policy].

§ 7 Liability
(1) We are liable for intent and gross negligence.
(2) For slight negligence, we are only liable for breaches of essential obligations (cardinal duties), limited to typical, foreseeable damage.
(3) We are fully liable for damages to life, body, or health.

§ 8 Warranty
The statutory warranty rights apply.
Entrepreneurs: 12 months warranty period.
Consumers: Please inspect goods upon delivery and report any damage promptly. This is not a condition for asserting warranty claims.

§ 9 Contract Language
Contract languages are German and English.

§ 10 Final Provisions
(1) German law applies. For consumers, this applies only insofar as the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.
(2) UN Sales Law does not apply.
(3) Place of jurisdiction is Berlin, Germany (if you are a merchant).
(4) We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 1 Geltungsbereich und Begriffsbestimmungen
(1) Diese AGB gelten für alle Verträge, die zwischen Ihnen als Kunde und uns, Pohlmann & Völcker GbR, Collected Photo, Heynstraße 15, 13187 Berlin, Deutschland, über unseren Onlineshop https://collected.photo abgeschlossen werden.
(2) „Verbraucher“ ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend nicht ihrer gewerblichen oder selbständigen beruflichen Tätigkeit zugerechnet werden können. „Unternehmer“ ist eine natürliche oder juristische Person oder rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.

§ 2 Vertragsschluss
(1) Die Präsentation der Produkte stellt kein rechtlich bindendes Angebot dar.
(2) Durch Abschluss des Bestellvorgangs geben Sie ein verbindliches Angebot zum Kauf der ausgewählten Waren ab.
(3) Der Vertrag kommt durch unsere Bestellbestätigung per E-Mail innerhalb von 3 Werktagen zustande.

§ 3 Preise und Zahlungsbedingungen
(1) Alle Preise verstehen sich inklusive der gesetzlichen Mehrwertsteuer.
(2) Zusätzlich fallen Versandkosten an, die im Checkout deutlich angezeigt werden.
(3) Wir akzeptieren folgende Zahlungsmethoden:

  • PayPal

  • Shopify Payments (inkl. Kreditkarte, Apple Pay, Google Pay etc.)
    (4) Der Kaufpreis ist bei Vertragsschluss fällig.

§ 4 Versand und Lieferung
(1) Der Versand erfolgt mit DHL und Deutsche Post.
(2) Wir liefern nach Deutschland, in die EU und weltweit.
(3) Die Versandkosten richten sich hauptsächlich nach dem Gewicht (ggf. auch Größe) und werden im Checkout berechnet.
(4) Lieferzeiten (geschätzt):

  • Deutschland: 2–4 Werktage

  • EU: 5–10 Werktage

  • International: 6–14 Werktage
    (5) Versand erfolgt in 1–2 Werktagen, maximal innerhalb von 3 Werktagen.
    (6) Tracking wird bereitgestellt.
    (7) Keine Selbstabholung möglich.
    (8) Lieferung an DHL Packstationen ist möglich.
    (9) Versand erfolgt Montag bis Freitag. Kein Versand am Wochenende oder an gesetzlichen Feiertagen. Es kann zu Verzögerungen kommen (z.B. Weihnachten, Ostern, Neujahr).

§ 5 Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

§ 6 Widerrufsrecht
Verbraucher haben ein gesetzliches Widerrufsrecht. Näheres siehe [Widerrufsbelehrung].

§ 7 Haftung
(1) Wir haften bei Vorsatz und grober Fahrlässigkeit uneingeschränkt.
(2) Bei leichter Fahrlässigkeit haften wir nur bei Verletzung vertragswesentlicher Pflichten (Kardinalpflichten), beschränkt auf den typischerweise vorhersehbaren Schaden.
(3) Für Schäden an Leben, Körper oder Gesundheit haften wir uneingeschränkt.

§ 8 Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte.
Unternehmer: 12 Monate Gewährleistungsfrist.
Verbraucher: Bitte prüfen Sie die Ware bei Erhalt auf offensichtliche Mängel und melden Sie diese schnellstmöglich. Dies ist keine Voraussetzung zur Geltendmachung Ihrer Rechte.

§ 9 Vertragssprache
Vertragssprachen sind Deutsch und Englisch.

§ 10 Schlussbestimmungen
(1) Es gilt deutsches Recht. Die Rechtswahl gilt gegenüber Verbrauchern nur insoweit, als nicht der Schutz durch zwingende Vorschriften des Staates des gewöhnlichen Aufenthalts entzogen wird.
(2) Das UN-Kaufrecht findet keine Anwendung.
(3) Gerichtsstand ist Berlin, sofern der Kunde Kaufmann ist.
(4) Wir sind weder verpflichtet noch bereit, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
